Terms of use
Effective
These are the terms for using Omibrook. They are short on purpose, and written to be read — the privacy page and security page spend their length establishing that we say exactly what we do, and terms that quietly took it back would make all three worthless.
Using the product means you accept them. If you are agreeing on behalf of a school or district, you are confirming you are allowed to.
Who you are agreeing with
Omibrook is operated by an independent sole operator trading as Omibrook (“we”, “us”). Contact: support@omibrook.com.
You must be at least 18 and be using this in a professional capacity — a teacher, case manager, specialist or administrator. Omibrook is not for children. There is no student login, and students never interact with it.
What it costs
The individual teacher tier is free, with no card and no trial period. Your whole caseload, not a capped number of students. We charge buildings and districts for the things buildings and districts need.
If paid plans are introduced for features you are already using for free, you keep those features at no cost on the account you already have. Paid plans, when they exist, are billed annually in advance, cancellable by you at any time, and the cancellation takes effect at the end of the paid year — we do not pro-rate refunds, and we will not bill an account that has asked to stop.
Your data, and who owns it
You own everything you put in. Students, goals, scores, accommodation records, the lot. You grant us only the narrow permission needed to operate the service for you: to store it, process it, generate sheets and reports from it, and show it back to you and to anyone you share it with.
Specifically, and these are commitments rather than current intentions:
- We do not sell your data or anyone’s.
- We do not use it for advertising.
- We do not use it to train AI models, ours or anyone else’s. Where a feature sends text to a model vendor, it is disclosed on the privacy page and the vendor does not train on it either.
- We do not look at your records except when you ask us to help with a specific problem, or where we are legally required to.
You are responsible for having the right to enter the data you enter — which for student records means your school or district’s authorisation. We cannot know that for you. What we can do, and do, is make the product usable while holding as little as possible: initials and a grade band are the only required fields, and a student’s name is optional and blank by default.
What you may not do
- Put data in that we have said we do not hold, by forcing it into a free-text field. Dates of birth, student ID numbers, guardian contact details and medical records have no column in our database, and typing one into a goal does not make it safe to store there.
- Share your account. A login belongs to one person. Involving a colleague in data collection is what collection links are for — they show initials only, are scoped to the goals you pick, and can be revoked.
- Attack, overload or probe the service, or try to reach another teacher’s records. Testing your own account’s security is fine and we would like to hear what you find — see the security page.
- Scrape the product, or resell access to it.
- Use it to do something illegal, or to harm a child.
What we promise, and what we don’t
We will try hard to keep this running and to keep your data safe, and the security page describes the specific mechanisms rather than asserting a posture. But the service is provided as it is, with no warranty. We do not promise it will be available at a particular time, that it will be free of faults, or that it will suit a particular purpose. There is no uptime guarantee attached to a free product operated by one person, and a stated one would be a fiction.
Keep your own copies of anything you depend on. This is not a disclaimer dressed up as advice — a progress report going into an IEP file or to a parent is a legal document for your district, and it should not exist only inside one vendor’s database. Export it. We back up our database, but your backup is the one you control.
Omibrook keeps a record; it does not make professional judgements. It generates sheets, stores what you score and drafts narratives from the figures you collected. Deciding whether a goal is being met, what a child needs, and what goes into an IEP is yours. Nothing here is educational, clinical or legal advice, and a drafted paragraph is a draft.
Liability. To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for lost profit. Where liability cannot be excluded, it is limited to the greater of the amount you have paid us in the previous twelve months or one hundred US dollars. Nothing here limits liability for anything that cannot lawfully be limited.
Ending it
You can stop at any time. Ask us to delete your account and everything in it goes, by cascade through the database rather than by a flag being set. Export first if you want a copy; see Privacy for how both work today.
We can suspend an account that is attacking the service, trying to reach other people’s records, or breaking the law. We will tell you why.
If we shut the product down, we will give at least 90 days’ notice to the address on your account, and keep export working for the whole period. A product that holds a year of a child’s progress data does not get to disappear on a week’s notice, and 90 days is enough to cross a reporting period.
Changes to these terms
We will update this page as the product changes. For a change that materially reduces what you get or increases what you owe, we will email account holders at least 30 days before it takes effect — not post it silently and treat continued use as agreement. If you do not accept a change, stop using the product and ask for your data; that is the remedy, and it is a real one because export and deletion are free.
Law and disputes
These terms are governed by the law of the United States and of the state in which the operator resides, and any dispute will be heard in a court of competent jurisdiction there.
There is no arbitration clause and no class-action waiver here, and their absence is deliberate. Both are standard and both would be to our advantage. They are left out because this product is sold on the claim that its documents say what they mean, and a clause removing a customer’s right to a court would be the loudest possible contradiction of that.
Before any of that: email support@omibrook.com. Almost everything is a misunderstanding or a bug.
The rest
If a court finds part of these terms unenforceable, the rest still stands. If we do not enforce something immediately, we have not given it up. These terms, together with the privacy page, are the whole agreement between us, unless your district has signed a separate data processing agreement with us — in which case that document wins on anything it covers.
